Case
Our case is guided by the Oregon Supreme Court decision in the case of Roberson vs. Ellis in 1911 in which the court elaborated lost treasure law.

After the defeat of the Spanish Armada, many English ships sailed to the American West Coast to loot the Spanish Gold Fleet. Like Drake had done, they captured sailors and ships and hauled the gold back to England via the Philippine Islands (named for King Phillip II). In one instance, a ship was landed and the gold was buried. No one returned to recover the gold. It is possible that the location was lost and forgotten. The region was not on the current maps.
The area to the north of Mexico was named 'California' after a nice place in an old Spanish novel. The only known clue about the location of the lost treasure may have been that it was buried somewhere in 'California.'

Following the identification of the treasure site, John Sassor formed the Francis Drake Company in August, 2007, to assist him with the treasure recovery. The shareholders include a logistics engineer.
The lawyers who are employed by John Sassor include members of a large regional law firm as well as individual attorneys who offer specialized and separate service.

Treasure Trove Act
A state legislature may pass a law which limits or restricts a treasure finder's rights of ownership. In order to overturn a common law (court law) right, they must be very specific. The Oregon legislature passed such a law in 1983. (Former ORS 273.718) They were attempting to control treasure cases including this one. (See, e.g., OR Hse. Comm. on Ag., For., and Nat. Res., April 4, 1991, HB #2549 - comment by Rep. Dwyer.)
The law was changed many times. It prevented the person that found the treasure from digging & required the filing of as many as 5 separate permit applications describing the treasure location. (State employees would later decide which permit really applied & determine the ownership issues.)
After many committee hearings in the 1990's, the Act was repealed in 1999. It was too restrictive and confusing. They felt that it had discouraged investors and treasure recovery companies.
The Treasure Trove Act existed side by side with current archaeology codes which cover digging for relics from indigenous cultures. The repeal of the Act sends treasure law in Oregon back to the Supreme Court's lost treasure law and leaves the state in charge of native artifacts.

Project History
A graduate of Willamette University, John was nominated in 1984 as Oregon's Entrepreneur of the year for his Shiitake mushroom factory, Forest and Farm Products Co., and growers association in Salem. He has a great deal of business experience including being the recipient of the state's $250,000 annual business grant.
John was mentioned in a Wall Street Journal article on October 11, 1984, and many local newspaper reports for his successful business structure. He was also interviewed by a Portland TV station.
